Ethical Issues with Illegaly Downloading Music

For years now people have found ways to take music off the Internet and put it onto their own computer, iPod, or blank CD. It all started in 1999 with the creation of Napster. Napster introduced a revolutionary new idea that was to forever change the way people thought about music: peer to peer file sharing. Peer to peer file sharing, often abbreviated as simply p2p, allows different users swap songs, with no regards for copyright infringement.Now the most popular way to take music off the Internet is to use one of many YouTube to mp3 converter sites These sits allow you to copy a URL from a YouTube video and paste it into a text box on the YouTube to mp3 site which will then convert the video into a music file that is downloaded onto your computer. Many people have different feeling about using these new YouTube to mp3 sites and using older sites similar to Napster. Either way, using sites like that is simply taking music off the web at no cost to oneself. I will go on to defend the idea that illegally downloading music is stealing.Illegally downloading music is no different then going into a store and taking a CD right off the shelf and walking out without paying. I will base my defense on the concept that the artists and the people involved in the music industry have rights. Whenever a song is downloaded off the Internet illegally it is a violation of the artists and the people involved in the music industry’s rights. My first premise is that artists and people in the music industry have the right to be compensated for their hard work. Most artists dream to make it big one day and be paid for the songs that they write and sing.When a person puts in the hard work that it takes to make it to the top they should be compensated for their efforts. However, the artists do not make the music and hit records all on their own. There are many people behind the scenes that contribute to the making of albums. For example there are the people who control the audio equipment and run the recording studio. Everyone involved in the music industry has the right to be compensated for the work that they have done. It is not right for someone to essential go to work, make a product, and then have someone else take it free of charge.My second premise is that illegally downloading music is a form of stealing. Taking something that does not belong to you is against the law. Taking someone thing that has a known money value and not paying one cent is down right stealing. One credible analysis by the Institute for Policy Innovation concludes that global music piracy causes $12. 5 billion of economic losses every year, 71,060 U. S. jobs lost, a loss of $2. 7 billion in workers' earnings, and a loss of $422 million in tax revenues, $291 million in personal income tax and $131 million in lost corporate income and production taxes.So not only are revenues are being affected by this music theft but jobs are being stolen away as well. Some people feel that the artists do not deserve all of the money that it costs to purchase one of their albums or even a single song off of iTunes. When you see pictures, videos, and interviews of music artists they do not look or sound like they are struggling to get by. Now-a-days artists are making profits off of country and worldwide concert tours. Some are even paid for personal appearances. Others have teamed up with various brand names and started endorsing their products while being paid to do so.To the average person it does not feel like taking songs off the Internet is actually affecting the artists themselves. If these famous artists are living the good life it should not matter that the average Joe saves a few dollars and downloads music off the internet. To contour the argument that artists have other ways of making money I will approach the issue in two ways. First of all stealing is stealing. Taking something that does not belong to you is wrong and will always be viewed as wrong. It does n ot matter what is being stolen or whom it is being stolen from.Second of all, as I have mentioned earlier, the artist are not the only people involved in the creating of songs and albums. As the Internet grows and the vast number of illegal downloads grows with it peoples jobs are shrinking. Less and less artists will be able to make music if the up and comers are not making any money to live off of. If new artists are forced to find other ways of making money their music career may never take off. If the number of people making music decreases so will the need for so many behind the scenes people.Overall illegally downloading music off the Internet is what it is, stealing. These actions not only affect the artists but so many more people that we do not always consider. Some feel that it is ok the take music from these famous artists but if it continues less and less music will be created, causing the high percentage of unemployment to only grow larger. When you steal from someone y ou are using him or her as a means to an end. No one should be used as a means to an end, especially when it comes to his or her livelihood.

European soy consumers have banded against these products outlining their case against genetically modified soy. Their purpose is to keep Brazil's soy products GMO free.Increasingly, Brazilians do produce Monsanto GMO soy products and can sell this product easily to China. European response to this is to partner with farmers in Brazil, who do not produce GM products, much like fair trade organizations. Soy and Agribusiness have come under a great deal of criticism. Much of this is environmental, political, economic, and social. However utilizing genetically modified plants and pesticides reduce the gamble a farmer makes; degrading the envir onment and employing less people to care for plants. The Coloroid Color system, masterminded by Professor Antal Nemcsics, provides a structure whereby people can easily identify harmonious color, setting up a chromatic balance and the color ranks. In the Coloroid system, the most important features are the color hue, brightness, and saturation. One of the main principles of the Coloroid system which promotes melodious color is its â€Å"aesthetically uniform color-space† (Neuman). Here, the observer sees the progressive change from one color into another on the spectrum. â€Å"The fluctuations range from minute gradients fragile enough to be quenched by artificial illumination to abrupt, linear, and sometimes almost crystalline transitions both of hue, and up to a point of value† (Fried). The synchronized transitioning from one hue and another, one tone to another, is the main objective. Just as scales are represented in music in movement from one octave to the next, color must stick to this gradual succession. The Munsell color system seeks to strikes equilibrium among colors through a lightness-contrast mathematical equation. In this harmony formula, the variables are the Euclidean distances or the color intervals where â€Å"the degree of harmony is a cubic function of the color interval† (Chuang). Another element of color harmony is the hue effect. The color harmonies respond in accordance with the lightness/ brightness, saturation contrasts. As a result, we have a chromatic concord through these color and light values. The hue effect or the Abney effect essentially explains the color’s alteration under white light. The harmonic formula to the hue effect is as follows: H’=-0.23 – 0.35 sin (h s (ab) + 0.83) – 0.18sin (2h s(ab + 1.55) Chromatic Difference is a product of the equal-chroma and equal-hue effects principles. The final harmony value is defined by an H(Δ) function at the ΔM meta†harmony value. Results have been proven by experimental  observations, too. In conclusion, the harmony of color is a concept which embraces the hue, saturation, and brightness of color. In addition, the unity of color is promoted by the smooth transition to the next just like the scales in a musical manuscript. The coloroid and the munsell systems help incorporate harmonious chromatic values into the kaleidoscopic spectrum of color. All of these characteristics contribute in making the life experience more enjoyable where the senses are very much attuned to engage with the world. It is now the renewable power utilization that is growing more, thus a small scale Wind Energy Conversion System is concentrated which needs harmonic reduction. The wind energy unit that we are planning to install is single phase so we go for a single phase to three phase ac-dc-ac converter designing to reduce harmonics. Parallel converters have been used to improve the power capability, reliability, efficiency, and redundancy. Usually the operation of converters in parallel requires a transformer for isolation. Here a single-phase to three-phase drive system composed of two parallel single-phase rectifiers and a three-phase inverter is proposed. Compared to the conventional topology, the proposed system permits: to reduce the rectifier switch currents; the total harmonic distortion (THD) of the grid current with same switching frequency or the switching frequency with s ame THD of the grid current; and to increase the fault tolerance characteristics. Also the loss of the proposed system is lower. The aforementioned benefits justify the initial investment of the proposed system, due to the increase of number of switches. Introduction The paper deals with the enhancement of the usage of renewable energy and improvement of its utility. Wind energy is one of the most promising alternative energy technologies of the future. Throughout recent years, the amount of energy produced by wind-driven turbines has increased exponentially due to significant breakthroughs in turbine technologies, making wind power economically compatible with conventional sources of energy. One of the limitations of wind energy is Harmonic distortion that hinders the utility of the wind generation. Harmonics is referred as the disturbance or the deterioration of the purity of current or voltage after undergoing several changes or transformations. Since power quality is very important it is mandatory to discover methods to reduce harmonics and retain purity. As corrective action is always expensive and unpopular solution more thought and investment are devoted at the design stage on the basis that prevention is better than cure. The sources of harmonics can be divided into 3 categories: Large numbers of distributed non-linear components of small rating. Large and continuously randomly varying non-linear loads. Large static power converters and transmission system level power electronics devices. Harmonics Reduction Technique In general there are many techniques to reduce harmonics like usage of harmonic filters [13] PWM technique [4], [5], [13] Filter is a device that is designed to suppress harmonic current and voltages from being injected into the power system since these causes damaging effects to the devices being used in the system. The harmful and damaging effects of harmonic distortion can be avoided by the usage of filters. There can be two types of filters that are used in order to reduce the harmonics distortion i.e. the active filters and the passive filters. Active harmonic filters are electronic devices that eliminate the undesirable harmonics on the network by inserting negative harmonics into the network. The active filters are normally available for low voltage networks. In order to control power and reactive power, it is essential to control the magnitude and phase angle of the injected voltage by the converter [1], [4], [5], [7]. At the same time, it is desirable to regulate the DC bus voltage. Another requirement is to minimize the injection of the lower order harmonics by the converter. The pulse width modulation (PWM) is utilized to achieve the following objectives: To control the output AC voltage for a constant DC voltage. To minimize the harmonics subject to the constraints on the switching losses, generation of noise etc. Circuit Design The project deals with a converter design as an attempt to reduce harmonic distortions in wind energy conversion system. We design a converter circuit for a single phase three phase conversion with two single phase rectifiers connected in parallel and a three phase inverter. The experiment is simulated using MATLAB Simulink software and the results are compared for the effectiveness of the converter circuit [9]. Also the selection of switch for the converter is very essential thus we compare two different switches- MOSFET and IGBT and analyze its characteristics for the suitability and effectiveness. Process of Switch Selection The below table shows the comparison of different parameters considered in the course of selection of switch for the converter thereby helping us to justify our selection. The Table below shows the comparison between different possible switches that are used in converters. We can see the characteristics and parameters based on which the switches are selected. TABLE I. Also the switching speed and switching losses are satisfactory. And it doesnt need a special switching angle control mechanism. Thus the MOSFET, IGBT rectifier/inverter system is the proposed converter for the small scale wind energy conversion system. Also comparison between MSOFET and IGBT operation in Single phase Three phase conversion as well as Three phase Three phase conversion is done. Technology used for switching The maximum achievable efficiency of any practical system is 0.93. However due to design considerations and operational constraints, the percentage drastically reduces to a maximum of 0.5, in the case of a wind energy system. The aim of this project is to improve the normal operating mean efficiency of 0.29. Various techniques have been instrumental in reducing the overall losses in the system, and also particular interest is streamlined in the domain of reduction of harmonics in the system. A lot of techniques by which, losses, and particularly, harmonics can be reduced have been figured out by analyzing various IEEE projects. Apart from circuit element modifications, design modifications have also been analyzed. Using MATLAB, you can analyze data, develop algorithms, and create models and applications. The language, tools, and built-in math functions enable you to explore multiple approaches and reach a solution faster than with spreadsheets or traditional programming languages, such as C/C++ or Java. Here we simulated converter circuit with MOSFET switches and IGBT switches and compared the difference in the capacity of reducing harmonics. FIGURE.3 RECTIFIER OUTPUT FOR MOSFET BASED SINGLE PHASE THREE PHASE CONVERTER USING MATLAB SIMULATION. This graph represents the rectifier output. The voltage amplitude is 310V i.e. the harmonics in the voltage causes spikes which reaches this value, where as the original voltage is around 230V. The graph is plotted for a time period of 20 milliseconds. The positive half wave is rectified better than the negative half wave. We can clearly see the spike occurrence in the positive half wave due to harmonics. . FIGURE. 4 FINAL OUTPUT OF THE MOSFET BASED CONVERTER SYSTEM USING MATLAB SIMULATION The output is around 220V with reduced harmonics. The inverter output by itself has reduced harmonics distortion found in the rectifier output. The spikes that were found in the rectifier are not present in the inverter output waveform. From this its evident that the single phase to three phase voltage converter design helps in reducing the harmonics. The MOSFET switch used is a voltage controlled device and has a high switching frequency that enhances the rectification as well as inversion of the generated voltage. The single phase to three phase configuration is helpful in reducing the harmonics is hence proved from the graphs above. ANALYSIS OF HAMONIC REDUCTION WITH VARIATION OF INPUT INDUCTANCE Initially we analyzed the system effectiveness for various input voltages like 230V, 220V, 200V etc., where we found a prominent result only for 220V input supply. Now that changing in voltage is not producing enough difference thus we try to change the input inductance and realize the effectiveness of the MOSFET and IGBT based conversion systems. FIGURE. 8 GRAPHICAL REPRESENTATION OF VARIATION OF HARMONICS WITH VARIATION OF INDUCTANCE IN A MOSFET BASED SINGLE PHASE THREE PHASE CONVERTER In the single phase to three phase conversion topology of converter using MOSFET, the inductors L2 and L4 (corresponding to the negative cycle of supply) are varied from 0.1 mH to 0.4 mH under a varying operating voltages between 220 V and 230 V. The results that are thus obtained are represented in the graph. For operating voltage 220 V, the output voltage peak varies between 214.4 V and 206.1 V corresponding to the change in input inductance values between 0.1 mH and 0.4 mH. Similarly, for operating voltage 230 V, the variation in peak voltage is between 224.2 V and 215.4 V for the same change in input inductance. In the single phase to three phase conversion topology of converter using IGBT, the inductors L2 and L4 (corresponding to the negative cycle of supply) are varied from 0.1 mH to 0.2 mH under a varying operating voltages between 220 V and 230 V. The results that are thus obtained are represented in the graph. For operating voltage 220 V, the output voltage peak varies between 219.4 V and 216.5 V corresponding to the change in input inductance values between 0.1 mH and 0.2 mH. Similarly, for operating voltage 230 V, the variation in peak voltage is between 229.8 V and 226.3 V for the same change in input inductance. In the above graphs we see the variation of harmonics with the variation of input inductance thus choosing the input inductance wisely can affect the harmonics reduction process. CONCLUSION As per the above result and discussion we saw the variation of harmonics with variation of voltage magnitude and input inductance accordingly, with the result we observe that single phase three phase MOSFET based converter reduces spikes to a great extent without any loss in the voltage magnitude when the input inductance is of 0.1mH each. But when the inductance is changed to L1, L3= 0.1mH and L2, L4=0.4mH the output consists of negative peaks without loss in voltage magnitude. Coming to IGBT based converter, the single phase three phase converter has low harmonics in the rectifier as well as the inverter outputs when the inductance in L1, L3=0.1mH and L2, L4=0.2mH.when the inductance is changed to 0.1mH all the rectifier output has little heavy spike at the junction of the half waves which are reduced without voltage loss.

Critiques of TWAIL Perspective and Investment Law CONSTRUCTIVE APPROACH TOWARDS INVESTMENT LAW CHALLENGING VIEWS OF THE THIRD WORLD APPROACHES The conventional view in western states among international legal scholars is that no comprehensible or distinctive Third World Approach is apparent in international law. While it remains undeniable that certain reoccurring issues trigger the same response from Third World states[1], per scholars the typical view expressed is that disparate strands do not weave together a sort of pattern.[2] Although they are grouped together beneath Third World rubric, it is a constitution of no more than ad hoc responses to discrete issues. The recognition of the Third World approach to any extent can only be categorised as reactive in nature. This is supported by Wolfgang Friedmann who argues that any difference in the approach taken by underdeveloped countries could be explained in terms of their lack of economic and political clout. Likewise, a couple years later the same perspective is argued that instead of challenging international laws fundamental assumptions, the third world scholars are st ill concerned with the responsiveness of international law focusing in regards to their interest.[3] Western scholars that are even sympathetic towards Third World approaches express similar views. For instance, Richard Falk has claimed that even explicit anti-Western works by third world scholars have been in reliance on western approaches in a moderately non-critical manner. Thus, Falk argues that the emergence of distinctive modes of thought and analysis failed to accompany the process of decolonization, or even to follow upon it.[4] Per Falk third world scholars are inclined to avoid any ideological imprint upon their work, as they want it to work scientific in a Western sense.[5] An analogy is created between third world scholars characteristics and Soviet scholars. Soviet scholars were pragmatically oriented towards enabling Soviet bloc participation in the prevailing debates in Western international law circles.[6] TWAIL scholar B.S Chimni supports Falk critique and argues that TWAIL has been stagnant as a critique instead of proposing practical alternatives to the issue. He makes this criticism clear in a passage from his work: While international lawyers from the Third World have challenged, often with success, Western perceptions of the history and content of international law and pointed to the inequitable nature of the body of rules bequeathed from the past, they have failed to propose and articulate an alternative approach which is inclusive and internally consistent. In fact, the matter has not received sufficient consideration. It is, therefore, not unusual to see a Third World scholar speaking of rejecting rules which are prejudicial to the interests of developing countries embracing a theory of international law and world order which seeks to justify and protect the status quo and has little to say about the developing world. This eventually leads him to assume positions which strengthen that which he had set out to fight.[7] A specific example where this perspective is mainly critiqued is from the failures of the NIEO. It is criticised for lacking breadth and Robert Rothstein claimed that short-sighted stance had been taken hence the reason the regime failed. Rothstein argued that instead of the regime being focused on how to create a clear strategy that will have both western and third world states mutual interests and consensual knowledge and technically sound proposals, the focus was on a strategy of confrontation and a demand for the acceptance pf biased and controversial principles[8] This shows that the TWAIL view is limited and has no practical alternatives to revolutionise the injustice upon third world states. Rather their methods are to flip the legal system and turn it into a bias third world system, which will not therefore lead to any justice and harmony within international law. This supports both Falk and Chimni claim of TWAIL lacking pragmatism and having a positive impact. TWAIL LIMITATION AND MORE CONSTRUCTIVE APPROACH TO INVESTMENT REGIME IN INTERNATIONAL LAW Even though the TWAIL critiques has been significant, nonetheless it has been flagged up to have several blind spots.[9] One of the fundamental blind spots flagged is the critique to suggest practical ways to remedy the deficiencies within international law (especially international economic governance). Although jurists do highlight theoretical arguments, it fails to suggest constructive solutions in improving the injustice upon third world states in the international system. Therefore, it is necessary to provide a constructive solution that will also take the third world states interests into account. The desires of the TWAIL perspective should go beyond being a mere instrument of system criticism.[10] It should have the ambition to form a constructive engagement; therefore, it should develop and lay out ideas that could be expressed in practical terms to improve the governance of international investment and economic law.   A key issue developing countries are faced with in international trade has been competitiveness of liberalization.[11] Refers to trade of western countries on preferential terms (PTs) with only chosen developing countries, which is incongruent with GATTs principle of only trading with your most favoured nation. Competitive liberalization is argued to have led to economic success to states such as South Korea (KORUS) and Mexico (NAFTA)[12] who benefited from regional trade agreements (RTA). But this was at the expense of neighbouring states who stayed relatively underdeveloped.[13]Evidentially competitive liberalization has a detrimental impact on other developing states ability to find markets that would give them a competitive and comparative advantage. In this sense TWAIL could be more effective and remedy this issue by spearheading the creation of geographically wider RTAs encompassing regional economic blocs in different parts of the developing world.[14] An example of the possible RTA could be between Economic Community of West African States and Mercado Comà ºn del Sur which would be valuable to both regional blocs. Thus, West African states will be able to supply the cotton, which is in demand in South America, due to the growth of the textile industry, while South Americans vice versa would have a market for electronic goods which is becoming essential in West Africa. This would be an approach that could be implemented to enhance the participation of developing states in international trade. TWAILs concern in the international investment regime is primarily related to the inequality of negotiations within arbitration treaty and International Institutional Agreements. Per TWAIL a practical approach could be implemented on IIAs, for instance with regards to BITs, developing states can create their own models. An example of this is apparent from the SADC (Southern African Development Community) BIT model. SADC BIT model consist of the same characteristics of a traditional BIT, just with the addition of striving more towards an equitable, fair and just participation within the foreign investment regime for third world states. The model is a representation of distinct efforts to enhance a sustainable development dimension of future BITs.[15] Such engagement with the foreign investment regime would create the welcoming environment that developing countries need to enhance participation in the foreign investment regime. Moreover, another unproductive approach from TWAIL within international investment law is the resistance towards investment treaty arbitration. Again, here there is a failure to suggest a constructive approach to rectify this problem that the third world are subject to. As apparent in the case of OCCIDENTAL PETROLEUM CORPORATION v REPUBLIC OF ECUADOR, the withdrawal of Ecuador due to its disregard to the unjust manners of the ICSID did not prevent the ICSID from awarding the largest damages to the investors which was a rough total sum of $1.7 billion plus 6% interest.[16] Consequently a more pragmatic approach for developing states is to implement their own arbitration centres equivalent to the AALCCs regional arbitration centres establishment within the African- Asian region.[17] But this should be done wi th a sustained participation within the current system. The establishments of these centres within the Afro-Asian region has been advantageous as it alleviates concerns of developing states in regards to participating in international arbitration. Besides that, it will promote better engagement in the foreign investment regime and facilitate more participation of developing states in the current system. CONCLUSION This chapter shows that there are flaws within the TWAIL theory and it is a critique perspective rather than a constructive one. Perhaps there are aspects of the investment regime that bring injustice within international law but constructive alternatives methods must be suggested to improve the system. This is where the TWAIL theory is limited and other perspectives such as first world scholars should be analysed before a conclusion can be made regarding the international law being unjust. CONCLUSION This thesis has discussed the accuracy of the TWAIL theory that investment regime in international law is used as another tool to support the domination of the Western world. This commenced by dating the emergence of TWAIL back to decolonisation era and ever since the aim of the theory has been to redirect international laws focus to the plight of developing countries.[18] TWAIL focuses on the significant paradigm shift from the historical relevance of the NEC and NIEO approaches to the regime bias. The regime bias theory has been emblematic of the entire system of international law and is even visible in International Institutions such as Arbitration. The regime bias critique illustrates developing countries sceptical attitudes towards the international economic governance which includes both international trade and foreign investment.   This is because, as Shalakany argues s the regime bias in international law empowers the investors, who come off as winners within the syste m at the expense of ignoring the Third Worlds interest. TWAIL argues that the international institutions increases the ideological gap to ensure that there is unequal participation in the system. Corporations being in control of resources in host states already provides constraints on a step towards a just investment regime. This is because it maintains colonial attitude which makes the Third World states passive rather than active participant in the investment regime. Likewise, the International Functioning Institutions have also helped to maintain the dominance of Western States in International Investment by promoting globalization, and making it a mandatory requirement to for Third World States to adopt privatization programmes to create more favourable investment climates for the investors.[19] Nonetheless a fundamental blind spot[20] of TWAIL critiques is that it fails to offer avenues for a constructive engagement of developing countries in the investment regime in international law. TWAILs shortcomings have highlighted the need for a pragmatic solution instead of just being a mere critique[21] tool of the international law regime. It has been criticised for being very repetitive and staying stagnant on the idea of l law responding to Third World interests instead of challenging the fundamental issues in international law. A more pragmatic approach for developing countries in the investment regime is seeking to alleviate their concerns and enhance their participation in the system. This would pave the way for a more constructive engagement of developing countries in the investment regime of international law and will also prevent the domination of the Western States, as the lack of participation is part of what has enabled the First World to be so powerful. I can conclude from this thesis that the investment regime in international law is subtle in the way it suppresses the developing countries and maintains the interests of the developed countries. Therefore, it makes it challenging to argue that the whole regime is unjust. However, although the TWAIL approach is rhetoric[22] in the nature of its arguments, I agree with the view that part of the key issues that supports the domination of Western States is the amount control they have in the key international institutions; for example, US being the largest shareholder in the World Bank. To constructively solve this issue, it could be argued that the starting point should be reconstructing the rules and process making of these institutions, in order for there to be a fair just and balanced participation between the less developed and developed states. There should then consist of a body who makes checks and balances to ensure that no states acts ultra vires.
